Eweb specializes in web development, design, and related services. Service specifics, including pricing and deliverables, are outlined in individual project agreements.

3. User Responsibilities

As a user of our services, you agree to:

  • Provide accurate and complete information during project initiation.
  • Use our website and services in compliance with applicable laws and regulations.
  • Refrain from sharing or distributing any content from our website without prior written consent.
4. Intellectual Property

This section governs the ownership of all work produced.

  • Ownership Before Payment: All content, designs, source code, and materials created by Eweb (including mock-ups and work-in-progress files) remain our intellectual property until full and final payment for the project is received.
  • Client Ownership After Payment: Upon receipt of final payment, ownership of the completed, delivered website and unique design elements will transfer to the Client.
  • Eweb’ Rights: We retain the right to display the completed work in our portfolio and marketing materials.
  • Third-Party Assets: The Client is responsible for ensuring all text, images, trademarks, or other materials provided to us do not infringe on the intellectual property rights of any third party.
5. Payment and Refund Terms
  • Payment Terms: Payments must be made according to the agreed-upon terms outlined in your project agreement. Late payments may incur additional fees or delays in service delivery.
  • No Refund Policy: Due to the custom, time-intensive nature of web development and SEO services, all fees and payments are non-refundable. Our work involves immediate allocation of time and resources. Payments are considered compensation for the time and creative effort expended up to that point. Any exceptions to this policy must be explicitly stated in the individual project agreement.
6. Termination of Services

We reserve the right to suspend or terminate services if:

  • A user violates these Terms.
  • Payments are not received as agreed.
  • The project scope changes significantly without mutual agreement.
 
7. Limitation of Liability and Disclaimer
  • Limitation of Liability: To the extent permitted by law, Eweb is not liable for:
    • Loss of data, profits, or revenue resulting from service use.
    • Issues caused by third-party platforms, hosting providers, or integrations.
    • Delays or service interruptions beyond our control.
  • Disclaimer of Guarantees: Eweb cannot guarantee specific rankings, traffic levels, or sales results due to the variable nature of search engine algorithms and market competition. We provide our services based on industry best practices and our expertise, but final results are dependent on factors outside of our control. The Client acknowledges that search engine optimization (SEO) is an ongoing process with no guaranteed outcomes.
 
8. Privacy

Your use of our services is also governed by our Privacy Policy.

 
9. Third-Party Services

Our website may link to third-party tools or platforms. We are not responsible for their availability, content, or terms of use.

 
10. Dispute Resolution

Any disputes arising from these Terms will be resolved through good faith negotiations. If unresolved, disputes will be subject to the laws and courts of the Republic of the Philippines.

We may update these Terms periodically. Continued use of our services after changes are made constitutes acceptance of the updated Terms.
